Account Creation

Once a user creates an account under GPL themes, you become a part of our GPL themes community and agree to the terms and conditions outlined below.

Terms Acceptance

Every user’s presence and use on the GPL themes site website is dependent on the acceptance of the user only to be bound by the terms & policies of our company to become a member or not. If one does now wish to accept the terms, they are requested to leave.

Subscription 

Users can subscribe to GPL themes from the website and become a member/ subscriber by filling up their real identity proofs. Once a user becomes a subscriber, they get access to the directory of items of GPL themes that are in accordance with our license.

Age

To become a member of the GPL themes community, the user needs to be 18 years or above. For the users below 18, they can subscribe through the parent/guardian account ( above 18 years of age) and use GPL themes, but the adult/guardian will be solely responsible for the activities of that account.

Responsibility of a user  

The user becoming a member of the GPL community must ensure/ promise to provide that all the information and details provided are true & accurate with the updated details like contact & email address. A user’s subscription is non-transferable under the GPL themes website, and the member would be solely responsible for any occurrence of a conjunction of personal details. Refunds Refund Requests

All the sales from the GPL theme website are considered final, given the nature of the digital content as one downloads it instantly after purchasing it. We do not provide any demo, a trial period, or a grace period once the user purchases or subscribes to any product. After download, there is no refund/return policy that we offer. 

Exceptions would be when GPL themes make changes in the given terms that affect the user and harm them materially or cause problems. In such cases, the company provides a pro rata refund for the whole unused months of the user.

When the product has already been downloaded, users requesting refund for memberships plans would not be taken into consideration.

No refunds would be processed in the following cases :

• User has changed his/her mind. 
• User subscribes to our product/ service by mistake. 
• User asks for goodwill/license/right to legally use it. 
• The user doesn’t have the ability to work on the purchased products. 
• Users won’t be able to download the product from our website if we have removed it from the main website. 
• User is in breach of company’s fair play/usage policy

Product Support 

The WordPress plugins provided by the GPL theme are provided “as it is” (exactly as provided). We do not guarantee their functioning and operating with us the 3rd party plugins and components by the users. Support needed for 3rd party components is not provided by us but by their owners. It is advisable that a user goes through the support terms of any product purchases before buying our product. Our support desk is available for the GPL theme products & services only for our website related issue and other queries.

Fair play and conduct 

As a member of the GPL theme, each member/subscriber must comply with the terms & fair use of policies. Being a part of our team gives an added benefit to those who comply with our policies and do not treat it as an automatic right. Our team members might be using reasonable discretion to check with our members whether they comply with our terms or not. For any of the reasons mentioned below, GPL theme would suspend or terminate your account permanently :

•  A user breaches the terms of the GPL theme
•  A user doesn’t act along with the values of the community 
• A user performs such actions which cause harm to us or others.

 You may not apply for a new account if we permanently delete your account from the GPL theme. 

We do not offer any refund to the members/user who goes through the termination process. Following are the reasons for termination of account 

• Intolerant behavior towards our team or support ( abusive language, negativity, etc.)
• An attempt to persuade our future or present customers in a negative way, or repeated defamatory statements 
• Illegal activities like piracy, spamming, hacking or promotion of any other competitor product or website 
• Attempting to manipulate our fair use policy (see below) in such a way that it is a threat to our interests.

Fair Use Policy 

GPL theme adopts & functions on a fair use & download policy. We want trusted and fair people to be a part of our community with real proof and not for others whose purpose is to add their stock. Our fair policy does not allow our users to share, resell or stack up any of our products. Anyone trying to go for these options their accounts would be terminated on an immediate basis with no refunds. 

Membership and/or Price Changes 

There is no promise for any particular product on our website that it will continue to be there. The GPL theme solely has the right to change, modify or remove any or all parts of downloads with or without any notice. The same goes for adding new downloads as well. The prices may change and would be updated on the website.

Links

The links provided or shared on our website are not reviewed by us. We do not take any responsibility for the content shared on the linked site, and those are not a part of our endorsements.

Trademark, Copyright and IP claims  

If a user or a visitor finds or believes that any section of the website or content on our website violates any intellectual property right, we request you to check it in our copyright policy. We, GPL Area, respect the law and others’ intellectual property rights.

Liability and Indemnity 

The users compensate us against all the demands, liability, losses or costs that the team of GPL theme incurs emerging out of or in connection with a 3rd party claim against GPL theme website or any of its product or service. All the items on our website are available to our users on an “AS IT IS” basis. We do not claim any warranties. GPL theme liabilities to its members are :

• We DO NOT include liabilities of the following things: revenue loss, goodwill loss, profit loss, customers loss, capital loss, reputation damage, loss of connection with other contracts, data losses, consequential or special loss, damage or expense.
• We are accountable and liable to you to an extent, i.e., providing our services as per your subscription/membership plan. After the expiry of the membership/subscription plan, we aren’t liable to offer anything.

Availability 

Our services and products are working 24*7 ( 24 hours a day and 7 days of the week). For any internet-related discrepancy, you might face some problems occasionally in accessing the GPL theme at any time or for any reason without any prior notice. The GPL theme would not be responsible for any of your losses due to the above things.

Third-party 

If any user becomes a member of the GPL theme community on behalf of a third person, then you promise us that you are liable to us and have the full legal rights & authority to bind that third party to the same person. Only people with real identities are welcome to subscribe to the GPL theme.

Consumer laws

There are some places wherein non-excludable warranties, guarantees, or other rights are included. We don’t modify, exclude, or restrict these terms and hence we are liable to replace or pay the cost of replacement of the relevant item or product (unless the non-excludable guarantees state otherwise). In other cases, we are only limited by the promises made in terms of use. The user, to keep in accordance with the export laws applied to them, must not use any item in violation of the same.

Blocking/Disabling of Your Account

If the GPL theme team finds any probability of any risk linked with the user, their subscription or payment in any breach of law or regulation, it may block you, terminate your subscription/membership or refuse the payment process. 

Some instances where we will follow these steps are: If a transaction is being processed from/to a person/country sanctioned by a known authority ( UN, European member states), or where our team believes is a legal risk or any loss to us or on our team. A user needs to promise, he/she is not from a sanctioned country and not a part of the sanctioned person list. In other countries where we can’t make or take payments, we will block the users from there as well. One should check all the payment methods available at their location before starting any process. Our company can and will take strict actions against these without any prior notice.  

GPL theme is a global website, we have different laws that may apply, and these may restrict our relationship with you.

Relationship between the parties  

Neither we nor you have any relationship that can bind the both of us in any way. There would be no type of partnership, joint venture, collaboration, employment or agency like the relationship between you or us or any of the members.

Notices

All kinds of notices submitted would be via email only at [email protected] either you mail us, or we mail it to you.

Changes in terms of services

In case of any changes in terms of services, the GPL team would notify our members/ subscribers about the changes. A user can also check it from their end through the updated version and the effective date for the same at our website footer. If any of our changes bring a material effect on a user, then the user may contact us about the same and cancel their subscription in accordance with Section 7 stated above. But, if a user continues to use our services even after the changes, then you become a part of the agreeing community regardless of the date on which changes were made. 

We care for you, and hence, any minor change to the terms of use will not have a material effect on you to your detriment.

Interpretation 

The words used like ‘include’ and ‘including’ are not considered as the word of limitation, and where it is within our discretion, the GPL Area means sole discretion.
